Description: This paper analyzes the treatment of advancement of legal fees to targeted employees in white collar criminal investigations. It argues that treatment of such fees as a contract right results in distortion to the criminal justice system and ignores the rights of other key stakeholders. It argues that adoption of a duty paradigm would recalibrate advancement to take account of the legitimate inerests of all constituencies.
